Section 106.14 of the Texas Alcoholic Beverage Code says that in the case of: "…sales, service, dispensing or deliver of an alcoholic beverage to an intoxicated person or a minor, action of an employee shall not be attributable to the employer if:"
- The employer requires its employees to attend an approved seller-training program.
- The employee has actually attended and passed an approved program.
- The employer has not directly or indirectly encouraged the employee to violate such law.
If one of your employees sells alcohol to someone who is already showing signs of intoxication and that person causes personal injury or property damage to someone else, the parties who are harmed may have legal grounds to sue to collect damages from your business.
Over the past thirteen years a growing number of alcohol liability lawsuits in Texas that have been settled both in and out of court have included attempts to collect damages from alcohol licensees for everything from auto accidents, personal injury, property damage, pregnancy, STD's, rape and fights.
If your business is sued in an alcohol related lawsuit, your business is afforded its greatest protection if all your employees are TABC Certified. Your best defense is to ensure all of your employees are TABC Certified within 30 days of employment.
Our TABC Certification program is an approved online TABC certification school, license #454-508. Per TABC regulations, you must complete the entire course within six hours. This means that if you start the program at 2pm, you must complete the program by 8pm the same day. If you fail to complete the program in the six hour timeframe, you will automatically be logged out of the program and required to start from the beginning free of charge.
Upon completion of the entire course and passing the final quiz, students will be able to print a temporary certificate online and a permanent certificate will be mailed within seven business days.
